BFM Radio Interview on Cross-Border Insolvency

 

On 24 April 2025, I spoke on the BFM radio station to speak on recent developments in the field of insolvency. First, with Malaysia’s intention to adopt the UNICTRAL Model Law on Cross-Border Insolvency through the Cross-Border Insolvency Bill. Second, the challenges of recovering overseas assets. Third, the rise of voluntary bankruptcies in Malaysia.

Set out below is an extract of one of the questions and my answer.

Why is it important for Malaysia to have specific laws on cross-border insolvency, especially on the business front?

Right now, Malaysia doesn’t have clear laws to recognise foreign insolvency proceedings. That’s a gap. But with the proposed Cross-Border Insolvency Bill, I believe it offers a strong economic selling point.

Malaysia is already open for business — we welcome foreign investment, and we make it easy to set up operations. But we also need to give foreign companies confidence that if they undertake a foreign restructuring or foreign insolvency, their Malaysian assets are protected and can be dealt with smoothly for repayment of debts.

This means certainty — certainty to operate here, even during foreign distress, and certainty that property can be repatriated or recovered efficiently.

Think of it this way — Malaysia welcomes foreign companies through special economic zones and secondary listings on Bursa Malaysia. If the company undergoes a restructuring or a liquidation, the Cross-Border Insolvency Bill ensures there’s a clear, predictable path to wind things down.

On BFM: Standalone COVID-19 Act is the Right Way Forward

This morning, I was invited by BFM Radio to share my thoughts on whether Malaysia should have a specific COVID-19 Bill. This is similar to the approach taken by Singapore. I also shared generally on how legal practice has been affected by the movement control restrictions and how it is important to leverage on technology.

Spoke on BFM: Unmasking Corporate Anonymity – Beneficial Ownership

On 16 December 2019, I spoke live on BFM’s Morning Run on the Companies Commission of Malaysia proposed guidelines on the beneficial ownership reporting framework. I had written earlier about beneficial ownership in Malaysia and also 8 observations I had on the proposed beneficial ownership guidelines.

The Malaysian Lawyer in the Media

Early on in my legal practice, I thought to myself that I would like to one day be featured in one of the business dailies. I wanted to work hard so that I had enough knowledge to share my views.

Coincidentally, I was already following Marcus’ Counsel column in The Edge. I did not know my fellow The Malaysian Lawyer back then. He was one of the few lawyers (if not, only lawyer) writing regularly on corporate-related matters at that time. I was thinking this relatively young lawyer, with the ang moh surname, already had his own column in a leading financial newspaper.

Marcus and I of course eventually met in person, became good friends, and then on a whim, set up The Malaysian Lawyer website. We wanted to continue to share our writing. Specifically, cutting out unnecessary legalese and use clear effective language in our legal articles.

From our small platform, the number of readers of The Malaysian Lawyer has exploded and it has been picked up by media outlets. Bloomberg TV, BFM radio and Focus Malaysia have all come across this website and invited me to speak with them.

More recently, I was featured on the cover story for Malaysia SME newspaper for their 11 June 2016 edition. I was interviewed on the impact of the new Companies Bill on SMEs in Malaysia. Continue reading

About two weeks ago, I had a pre-recorded interview with BFM to share my views on the new Companies Bill 2015.

I generally shared why the new changes are to be welcomed and I traced the long process to arrive where we are at. On the one hand, we adopted the best practices from other jurisdictions. However, I also shared my personal thoughts on certain areas where we could have improved further. Finally, I shared how the different segments of the industry may be worried about the unknown and of the new.
